DJ Services Agreement

Services

Nocturne agrees to provide professional DJ services for a duration of three (3) consecutive hours on the agreed event date.

Services include:

• DJ performance
• Sound system suitable for the agreed venue size
• Basic microphone for announcements
• Setup and breakdown within a reasonable time

Compensation

The total fee for each booking is quoted individually and confirmed in writing before the event is reserved. Rates vary based on date, location, event length, and any add-ons agreed upon.

• Payment is due in full before the event date.
• The event date is not secured until payment is received.
• No services will be rendered without full payment.

Overtime

If the client requests performance beyond the agreed 3-hour window, additional hours are available at the overtime rate quoted with your original booking.

• Overtime must be requested and confirmed in advance where possible.
• Additional hours must be approved and paid before service is extended.

Equipment Protection & Liability

The client agrees to:

• Provide a safe environment for the DJ and equipment.
• Ensure guests do not interfere with, touch, or handle equipment.
• Protect equipment from weather (rain, wind, excessive heat).
• Provide stable and appropriate power access.

The client is financially responsible for:

• Any lost, stolen, or damaged equipment during the event.
• Damage caused by guests, venue staff, or unsafe conditions.

The client agrees to reimburse Nocturne for repair or replacement costs at fair market value within 7 days of invoice.

Cancellation Policy

• More than 7 days before the event: full refund.
• Within 7 days: 50% retained.
• Within 48 hours: no refund.

If Nocturne must cancel due to an emergency, full payment will be refunded.

Force Majeure

Nocturne is not liable for failure to perform due to circumstances beyond its control, including but not limited to power failure, venue restrictions, natural disasters, or unsafe conditions.

Conduct

Nocturne reserves the right to terminate services without refund if:

• Guests become violent or threatening.
• Equipment is at risk.
• The environment becomes unsafe.

Intellectual Property

The Mixed by Nocturne brand, the Nocturne performance name, all photographs and videos featuring the DJ, original mix recordings and sequencing, this website's design, and all related branded materials are the property of Oryn LLC.

Unauthorized use, reproduction, redistribution, or commercial exploitation of any of the above is prohibited without prior written consent. Tracks featured within mixes remain the property of their respective copyright holders; mixes are presented as non-commercial DJ performances and promotional samples of services offered.

Event photography, recordings, or promotional content captured by the DJ during a booking may be used for portfolio and marketing purposes unless the client requests otherwise in writing before the event.

Agreement

Booking confirms acceptance of these terms. The full signed agreement is shared once an event date is reserved and includes your name, event details, and payment method. Agreements are entered into with Oryn LLC, doing business as Mixed by Nocturne.
